Start here: The insurer handling the conversation does not tell the whole story. Identify whose policy is involved and what claim you are pursuing before deciding your next step.
First-party means a claim under your own coverage
For example, you might use your collision coverage after another driver damages your vehicle. It remains a first-party claim under your policy even if you did not cause the collision. Coverage, deductibles, claim duties and available dispute procedures depend on the contract and law.
Third-party means a claim involving another party’s responsibility
After a collision caused by someone else, you may pursue a liability claim handled by that person’s insurer. In South Carolina, the underlying claim commonly involves tort principles such as negligence: who is responsible, what damage they caused and what losses can be proven. An insurer’s estimate is part of claim handling; it does not by itself explain every issue in the underlying claim.

| Question | First-party claim | Third-party claim |
|---|---|---|
| Whose coverage? | Your own applicable policy, such as collision coverage. | Usually the responsible driver’s liability coverage; the underlying claim concerns that party’s responsibility. |
| Starting point | The contract, applicable endorsements, facts and law. | Liability, causation, supported damages and available coverage. |
| Deductible? | An applicable deductible may initially be your responsibility. | Do not assume your own collision deductible defines the liability claim. Payment can still depend on responsibility and other issues. |
| Policy appraisal? | Check your own provision and whether it applies. | Your policy’s clause does not automatically bind the other driver’s insurer. |
| Diminished value? | Read the actual coverage and exclusions. | Ask an attorney whether the evidence supports pursuing it. |
Why we recommend an attorney conversation
We strongly encourage owners with disputed third-party vehicle damage to consult an independent South Carolina attorney early. This is especially useful when repair payment, diminished value, loss of use, a release or responsibility is in question. Ask the attorney what losses may be considered, what evidence is needed, what deadlines apply and how their fees affect the decision.
An attorney evaluates legal rights and strategy and decides whether to accept representation. We supply repair-related facts within the agreed scope. Choosing counsel does not guarantee full payment, a faster settlement or a particular recovery.
Can both insurers become involved?
They can. Your own insurer may pay under applicable coverage while pursuing reimbursement from another party. Deductible recovery is not automatic. Uninsured or underinsured motorist coverage can introduce other requirements. Ask your insurer and, where appropriate, your attorney how the available paths interact; do not assume one path eliminates all other duties or deadlines.
Appraisal, arbitration and legal advice have different roles
Policy appraisal depends on a contract provision. South Carolina’s DOI also describes a separate automobile property-damage liability arbitration process and identifies limits on its use. Do not assume a process that fits one claim applies to another. Ask an independent professional which option, if any, suits your circumstances before incurring fees.
Our role at Big Chris Collision in Aiken
We identify and document the vehicle’s repair needs, explain our repair plan and discuss known payment differences before authorization. With your permission, we can share relevant photographs, measurements, scan findings and repair records with a professional you retain. We can also discuss connecting you with independent legal counsel when requested; representation is separate from our repair services.
Bring these questions to the next conversation
- Am I claiming under my policy or pursuing another party’s liability?
- What issue is actually disputed: coverage, responsibility, repair work or value?
- Which losses and documents should an independent professional review?
- What would I authorize or release by signing this document?
- What costs remain unresolved, and who is explaining them in writing?
